Domestic abuse is a serious problem and sadly can be a very real part of a modern relationship. Raleys have helped people in many cases involving domestic abuse, so if this situation does affect you, please be assured that we will do our utmost to deal with your case as a matter of urgency to ensure yours and your children’s safety.

Domestic abuse includes personal violence, threats, intimidation and harassment. Our family law team are able to provide a sympathetic approach and advise you as to the options best suited to meet your particular needs.

Police Intervention

If you are a victim of domestic violence then you must contact the police. They will arrest your partner if they have committed a criminal offence. If you are threatened by your partner and you inform the police they may record your complaint and give your partner a warning. If the behaviour then continues, they will be able to arrest them under the Protection from Harassment Act 1997.

Non-Molestation Order with Power of Arrest attached

This is an order available from the civil court. It will protect you from violence or any other kind of conduct which could be construed as harassment or pestering. The order, if made, will then be served on the other party by an enquiry agent at which stage it will be effective. If the order is breached in any way whatsoever then the other party would be brought before the Court and asked to show good reason why they should not be committed to prison

If a Non-Molestation Order is made the Court will automatically attach a Power of Arrest. This means that the order will be served on the local Police station and, if your partner is found to be in breach of the order, the Police are entitled to arrest them in circumstances where they may not ordinarily have a power of arrest.

Occupation Order

This order requires the abusive partner to leave the family home and orders that they may not return to the property or go within a set distance of it. Again, if the order is breached, the other party would be brought before the court and could be sent to prison for breach of the order.
