Introduction

Have you lost damages because of the professional negligence of a solicitor in the conduct of a personal injury or medical negligence claim?

Do you need to know whether you can sue your previous solicitor?

As with any other professional, you can sue a solicitor if their negligent advice, negligent action, or failure to act has caused you financial loss.

There is still a public perception that one solicitor will not sue another solicitor because of an unwritten “code of conduct”. We do sue solicitors when the facts justify it.

Professional negligence is a specialised and complex area of law. With this in mind you should know that Raleys have:-

  • recovered damages for clients in professional negligence claims against many firms of solicitors, including regional and national firms
  • acted for over 100 clients in professional negligence claims against one firm of solicitors
  • recovered damages of over £1 million against one firm of solicitors in respect of their professional negligence in the conduct of vibration white finger claims
  • recovered damages of over £100,000 against another firm of solicitors in respect of their professional negligence in the conduct of vibration white finger claims
  • recovered damages of over £120,000 for a client against a firm of solicitors in respect of their professional negligence in the conduct of a medical negligence claim

If you want to sue a solicitor because of negligence in a personal injury claim you need a firm with experience of that type of claim (for example: accident, medical negligence, or work related illness) and claims for professional negligence against solicitors.

Group Actions

Raleys are also part of a select national panel of specialist solicitors who have been appointed by the Legal Services Commission (LSC) to the Multi-Party Action (MPA) Solicitors’ Panel Group Actions. These are claims in a group action by a number of people who have suffered injury or disease at the same time or in similar circumstances.

Only 22 firms in England and Wales are on the LSC MPA Panel. To join the Panel each firm has to show recent substantial involvement in the coordination or management of at least three group actions.

Raleys have been involved in group actions involving professional negligence claims.
